New Rules to Stop GPA Stamp Duty Evasion for Delhi Property Registration

Delhi’s updated property registration rules target GPA stamp duty evasion and property fraud. Disguised sales via General Power of Attorney now face strict scrutiny, requiring full conveyance deed fees and official Collector of Stamps approval. 

If you are planning to buy or sell a house in the national capital, you need to stay updated on the latest changes regarding Delhi property registration. The government has recently overhauled the system to tackle illegal activities like land mafias and deep-rooted property fraud in Delhi. A primary target of this crackdown is the widespread misuse of a General Power of Attorney (GPA), which historically allowed people to bypass massive fees by executing what effectively amounted to a hidden property sale agreement rather than a transparent transaction.

To stop widespread stamp duty evasion and secure vital public earnings, new directives have been issued to every Sub-Registrar office in Delhi. Under these updated Delhi real estate rules, standard immovable property registration will undergo heavy document screening. Moving forward, if a GPA essentially works like an ownership transfer, it will be flagged and redirected straight to the Collector of Stamps, who will decide if it needs to be registered as a standard Conveyance Deed instead.

Why is the Delhi Government Cracking Down on GPA Registrations?

For years, a massive loophole existed in the real estate market. Instead of paying the full stamp duty required to completely transfer a property, many buyers and sellers used a GPA to hand over control. By doing this, they only paid a nominal, tiny fee.

Delhi Chief Minister Rekha Gupta highlighted that while these documents were labelled as simple power-of-attorney forms, they were functioning behind the scenes as full sale agreements. They included clauses for the exchange of money, the physical transfer of possession, and the permanent shift of ownership. This practice led to severe revenue loss for the state and left everyday buyers exposed to defective property titles and fraudulent scams. The new crackdown aims to bring safety back to the market and ensure everyone pays their fair share.

How Does a GPA Transfer Differ From a Conveyance Deed?

Think of a true GPA as a helpful tool: you are simply authorising someone you trust to manage your affairs because you cannot be there yourself. A Conveyance Deed (often called a Sale Deed), on the other hand, is the official legal vehicle that completely cuts your ties to the property and hands ownership to someone else permanently.

To give you a clearer picture of how the market is changing, here is how the two paths stack up under the new scrutiny:

What Are the New Rules for Registering a GPA in Delhi?

The days of quick, unquestioned power-of-attorney filings for property sales are over. The government has instituted a strict regime of property document scrutiny at the Sub-Registrar level.

When you submit a GPA now, officials will inspect it like a hawk. They are specifically looking for four major red flags:

  • Monetary Consideration: Has any money changed hands as part of this agreement?
  • Transfer of Possession: Is the buyer already moving in or taking over the physical space?
  • Irrevocability: Does the document state that the power cannot be cancelled or taken back?
  • Permanent Authority: Does it grant the person permanent rights to sell, gift, or mortgage the asset?

If the document matches any of these descriptions, the Sub-Registrar cannot register it. It will instantly be forwarded to the Collector of Stamps, who has 30 days (or up to 3 months in complex scenarios) to issue a formal order on the correct stamp duty owed.

Who Can Directly Register a GPA Without the Collector’s Approval?

The government understands that genuine family arrangements shouldn’t be choked by bureaucratic red tape. Because of this, an exception has been carved out for close blood relatives.

If you are genuinely passing management rights to an immediate family member, your document will bypass the Collector review line and can be registered directly by the Sub-Registrar. This close family circle strictly includes:

  • Parents
  • Spouses
  • Sons and daughters
  • Brothers and sisters

If the person you are appointing falls outside this immediate family tree, your document automatically heads to the Collector’s desk for evaluation.

What Happens if a Sub-Registrar Violates These New Rules?

The government is taking enforcement incredibly seriously. Any Sub-Registrar who bypasses the protocol and registers a disguised sale document without sending it to the Collector will face immediate penal and disciplinary action.

To keep everyone accountable, every local registration office is now legally mandated to maintain a dedicated standalone register for these flagged cases. They must also submit comprehensive monthly progress reports directly to the state headquarters, ensuring no suspicious property deals slip through the cracks unnoticed.

How Can You Track the Status of Your Property Registration Now?

Waiting for government approvals can feel stressful, especially when large financial investments are on the line. To ease this friction, the Chief Minister has ordered the fast-tracked development of an internal online tracking system.

Scheduled to roll out within a short timeframe, this digital portal will allow citizens to monitor the exact stage of their property review transparently. It aims to eliminate corruption, cut down wait times, and give you peace of mind that your documents are legally sound and fully protected against future disputes.

Government Seeks Extra Funds to Transform Unauthorised Colonies!

Alongside tightening property registration rules, the Delhi government is moving ahead with a massive development plan for millions of residents. If you live in any of the capital’s unauthorised or irregular colonies, the landscape of your neighbourhood is set to change very soon.

The Delhi government has requested additional funding (approximately ₹100 crore) from the Central Government to fast-track the regularisation of these colonies. This financial boost is specifically designated to effectively execute the revised PM-UDAY scheme on the ground.

How Will This Impact Citizens and the Real Estate Market?

Once these funds are deployed, major infrastructural and legal transformations will roll out across these neighbourhoods:

  • Clear Path to Ownership: Under this scheme, residents will finally receive clear, official, and legally recognised ownership documents for their properties.
  • Rapid Infrastructure Development: The regularisation will allow the state to legally deploy civic infrastructure, meaning these areas will soon see properly paved roads, functional sewer lines, clean water supply, and public parks.
  • Hassle-Free Registration: As these colonies shift into the regularised category, residents will be able to execute standard, transparent property registrations directly at the Sub-Registrar offices without relying on risky legal loopholes.

The government is utilising a balanced approach, cracking down heavily on tax evasion and property fraud via disguised GPAs on one hand, while actively working to uplift everyday citizens by securing their housing rights on the other. A major, positive transformation is on the horizon for Delhi’s housing landscape!
