In India, the Record of Rights (ROR), Jamabandi, and Patta are land records that are absolutely critical for ascertaining ownership and legal status of land. The Record of Rights details the rights of property, whether the land is cultivated, and the history of ownership. Jamabandi is commonly used in the northern states (for example: Delhi, Punjab and Haryana), and is referred to as a revenue account that is usually updated every 5 years. Patta is used in southern states (for example: Tamil Nadu) and is regarded as a land ownership record issued by the government. These land records are essential for any sort of transaction regarding land rights, updating or mutation of land records, and any amount of agricultural loan application. The electronic availability of the Record of Rights, Jamabandi and Patta via a government portal has added a degree of transparency to housing documents, increased the confidence in the verification of land records, and opened up ecological development by enhancing real estate reliability and convenience when obtaining legal agreements.

What do you mean by Jamabandi?

In the context of land records in India, particularly in the northern states, Jamabandi is a record of rights with information about ownership of the land, cultivation, and revenue-related details for a particular piece of land. It is more or less a legal document for the ownership of some particular plot of land or how it is being used.

Is jamabandi evidential proof of ownership?

No, jamabandi is not considered conclusive evidence of ownership and is not definitive proof of ownership, it is a strong evidence which provides the current ownership tenancy as well as revenue particulars which reflects the person who is recognized by the State government as the owner for revenue and administrative purposes, but jamabandi does not actual confer legal title.

What is the difference between Jamabandi and Patta? 

Jamabandi and Patta are both terminology related to titles for land rights, but they are also different in the extent and regional specificity. Jamabandi is a very detailed account of land rights in general that is normally referred to in North Indian states, which typically record land ownership, tenancy, and other information. A Patta is a document granting the right to occupy and use a specified parcel, generally issued in South Indian states. Thus a Jamabandi represents a broader, comprehensive record, whereas a Patta is a particular record of land entitlement.

Jamabandi vs. Fard what is the difference?
In terms of Indian land records, Jamabandi and Fard are related but different documents. Jamabandi, also called the Record of Rights (“RoR”), is a comprehensive document that provides details about ownership, tenancy details and revenue for particular area. According to Landeed Jamabandi serves as a baseline document for legal verification and deed verification in land transactions. Fard is an extract or copy of the Jamabandi, which includes details of a particular piece of land including ownership, survey numbers and applicable fees.

Is Jamabandi not proof of title?

Jamabandi is not proof of title in India. Jamabandi is a revenue record used for revenue purposes, such as collecting land revenue, that may reflect the details of possession and mutation, but it does not show legal ownership.

What is Jamabandi and what is the record of rights?

In various states of India, Jamabandi and Record of Rights (RoR) mean the same thing. The document of Jamabandi is referred to in some states like Haryana and Punjab; and Record of Rights (RoR) is a more general way to refer to a document showing ownership of the land, area cultivated, as well as ownership rights. Jamabandi is probably a type of RoR.

How can I obtain proof of ownership?

To prove ownership, usually some combination of documents will be needed, with the title deed (or sale deed) constituting the most essential piece. Property tax receipts, utility bills, and registration documents can assist in documenting ownership. In India, an ownership certificate can also be obtained for the property from a local municipal authority or land revenue office, upon application along with any of the additional documentation.

Is it possible to sell land on Patta alone?

It is theoretically possible to sell land on patta documents only but there may be some complications, as a Patta is essentially a revenue record issued by the Revenue Department of the state.  It identifies who is shown as the ‘owner’ in the government records for purposes of revenue (paying land tax).  While it is good evidence and an indication of possession and recognized ownership by the revenue authorities, it does not convey legal title in the manner that a registered Sale Deed would do.

What is the appearance of a Jamabandi?

A Jamabandi is also called a Record of Rights (RoR) or Record of Entitlements (RoE), is a document containing the detailed ownership, cultivation and other rights over a piece of land. It would convey the name of the owner of the land, area of the land, and any encumbrances which include mortgage. Depending on the state the format and specific information may vary, but a Jamabandi generally contains: location, owner details, property ownership details, classification of the land, cultivation details, details regarding tenant, details regarding taxes, and details regarding encumbrances.

Which Indian states have Jamabandi? 

‘Jamabandi’ is a land record document that belongs to a select group of North Indian states. These states include Punjab, Haryana, Rajasthan, Himachal Pradesh, and Jammu and Kashmir, according to some real estate websites. Jamabandi is a Record of Rights (ROR) document reflecting, among other factors, ownership status, cultivation, etc.

Who has the authority to cancel my Jamabandi? 

Usually, the revenue authority or civil courts have the authority to cancel a Jamabandi. However, each state differs and the authority also depends on the situation. Generally, the revenue authority usually cancels for administrative reasons, and for civil court, this is done where there is a dispute or challenge to the Jamabandi.

Who has the authority to cancel patta? 

In most of the states of India, the Revenue Divisional Officer (RDO) or Collector generally is the one who cancels a patta. However, in most cases, it may differ across states. For example, in certain instances, the patta issued by Gram Panchayat can also be cancelled by the Additional Collector.

Who has the authority to cancel ROR?

Only a court order or consent from both parties can cancel the registration of a sale deed. The sub-registrar cannot independently cancel a registered sale deed.

Who approves Patta?

The local Tahsildar or revenue officer of the state revenue department approves a Patta. While issuing the Patta, the Patta will be issued in the name of the landowner once he/she is verified as the true landowner. A Patta is an acceptable legal record of land ownership. It will be needed for registration of property, in mutation, or claiming any services (government schemes, etc) related to the land.

How do I check my Jamabandi?

To check the Jamabandi record online, you can visit your state land records website by providing all of your details. The details are the district, tehsil, village, and Khewat number. The Jamabandi record can be accessed digitally, so it is faster to check land records for ownership, cultivation records and mutation status. This will allow buyers and owners to stay transparent with the land records.

What is the Jamabandi period?

The Jamabandi duration is 5 years in most parts of India. During this duration, the revenue department conducts a survey of the land records and updates the record to ensure that the documents reflect the correct ownership, cultivation status of a land and tax details. This regular updating of records makes sure land records are accurate and reliable, especially for legal verifications, mutation, and efficient transfer of property in rural and agrarian areas.

Is it possible for a revenue officer to cancel my Patta?

If it was acquired from a fraudulent person, incorrect information or if the land is government owned, then yes, a revenue officer or Tahsildar can cancel it. It has to be due to proper inquiry and notice reasons however. The landowners are expected to keep the proof to continue to qualify the Patta as a landowner and to use the land pleadings of ownership under the Indian land revenue laws.

ROR or Record of Rights refers to a legal document in respect of lands and documents describing ownership, use and other documents pertaining to it.
